The total amount of the above fines was deposited in the City Treasury to the credit of the Sinking Fund, for the Payment of the Interest on the City Debt.

Pursuant to section 9 of chapter 338, Laws of 1893, one-half of the above amount is payable to the State and the residue to be divided equally between the Pension Funds of the Police and Fire Departments.

Resolved, That a warrant payable from the Sinking Fund for the payment of the Interest on the City Debt be drawn in favor of the Chamberlain, for the sum of Seven hundred dollars ($700.00), being the amount of fines for violations of Agricultural Law, imposed and collected by the Court of Special Sessions, First and Second Divisions, in the months of June, to and including December, 1901, to be deposited by him in the City Treasury to the credit of account entitled "State Agricultural Law, Fines," for the purpose of distributing the said amount, pursuant to section 9, chapter 338, Laws of 1893.

Which resolution was unanimously adopted.

The Comptroller presented the following statement and resolution on the refunding of Croton Water Rents paid in error:

SIR-Application has been made, as per statement herewith, for the refund of Croton Water Rents paid in error. The applications are severally approved by the Commissioner of Water Supply, the Commissioner of Water Supply, Gas and Electricity, the Receiver of Taxes and the Collector of Assessments and Arrears, and the amount so paid, One thousand one hundred and fourteen and 46-100 dollars ($1114.46), has been deposited in the City Treasury to the credit of the Sinking Fund for the Payment of the Interest on the City Debt.

Resolved, That a warrant payable from the Sinking Fund for the Payment of the Interest on the City Debt be drawn in favor of the Chamberlain for the sum of One thousand one hundred and fourteen 46-100 dollars ($1114.46) for deposit in the City Treasury to the credit of "Croton Water Rents-Refunding Account," for refunding erroneous and overpayment of Croton Water Rents, as per statement submitted herewith.

Which resolution was unanimously adopted.

The Comptroller presented the following statement and resolution relative to a refund of $2.60 to Pierre E. Guerin, being an overpayment for street vault permit:

Hon. EDWARD M. GROUT, Comptroller:

January 23, 1902.

SIR-On September 9, 1901, Pierre E. Guerin paid the Department of Highways for permit to construct a vault under sidewalk in front of premises Nos. 21, 23 and 25 Jane street. By actual survey on completion of vault there appears to be an overcharge on estimated space occupied of Two and 60-100 dollars ($2.60). Mr. Guerin asks for the refund of this amount overpaid. With the application is submitted the affidavit of Mr. Guerin, the certificate of a city surveyor and certificate of Superintendent of Street Openings, Paving and Repaving, approved by the Commissioner of Highways.

The amount paid was deposited in the City Treasury to the credit of the Sinking Fund for the Redemption of the City Debt No. 1.

The Comptroller presented the following statement and resolution relative to a refund of $8.36 to William Whyte, being amount of assessment paid in error:

January 23, 1902.

Hon. EDWARD M. GROUT, Comptroller:

SIR-On March 9, 1900, William Whyte paid in errer the assessment on lot No. 71 of 108 in Block 980 for Brook Avenue Sewer, he not owning the said premises at that time, and the said assessment having been previously paid on December 18, 1899. Mr. Whyte, therefore, requests the refund of the amount of said assessment, so paid in error.

The amount of said assessment, Eight and 36-100 Dollars ($8.36) was deposited in the Sinking Fund for Redemption of the City Debt.

Resolved, That a warrant, payable from the Sinking Fund for the Redemption of the City Debt No. 1 be drawn in favor of the Chamberlain for the sum of Eight and 36-100 Dollars ($8.36), to be by him deposited in the City Treasury to credit of "Refunding Assessment, paid in error," to refund William Whyte, through said account, this amount of assessment for Brook Avenue Sewer, paid in error March Which resolution was unanimously adopted.

The Comptroller presented the following statement and resolution relative to interest to be credited to the Public School Teachers' Retirement Fund:

Hon. EDWARD M. GROUT, Comptroller:

January 23, 1902.

SIR-Pursuant to Chapter 296, Laws of 1894, as amended by Chapter 874, Laws of 1895 and Section 1083 of the Greater New York Charter, (Chapter 378, Laws of 1897), as amended by Chapter 91, Laws of 1898, the interest and income of the "Public School Teachers' Retirement Fund," shall become part of said Fund.

I hereby certify that from June 30, 1901 (P. M.), the date of the last adjustment, to December 31, 1901 (P. M.), the interest earned by the cash to the credit of said Fund was four thousand and twenty-five 96-100 dollars ($4,025.96), as per statement hereto attached.

This interest, together with all the interest on deposits to the credit of the "City Treasury," has been received and deposited to the credit of the "Sinking Fund for the Redemption of the City Debt No I."
