In connection therewith the Comptroller offered the following resolution: Resolved, That the Commissioners of the Sinking Fund hereby approve of and consent to the execution by the Board of Education, of a renewal of the lease to the City, from George Haar, attorney, etc., of the store of the building No. 1189 Bedford avenue, Borough of Brooklyn, used as an annex to the Commercial High School, for a term of one year from March 1, 1902, at a rental of Forty-five dollars ($45.00) per month, otherwise upon the same terms and conditions as contained in the existing lease the Commissioners of the Sinking Fund deeming the said rent fair and reasonable and that it would be for the interests of the City that such lease be made.

Which was unanimously adopted.

The following reports and resolutions were received from the Board of Education relative to a renewal of the lease of premises corner Radde and Payntar avenues, Long Island City, Borough of Queens:

To the Board of Education:

The Committee on Buildings, to which was referred a resolution adopted by the School Board for the Borough of Queens on November 26, 1901, requesting that the lease of the premises situated on the southwest corner of Radde and Payntar avenues, Long Island City, used as an annex to Public School 4, be renewed upon expiration, March 1, 1902, on the same terms of the present lease, respectfully submits the following:

The Deputy Superintendent of School Buildings for the Borough of Queens has reported that the building in question is a two story frame structure, which has been occupied for school purposes since prior to consolidation. The rental asked, $540 per year, is considered high, but, owing to the urgency of the case, the building being greatly needed for a longer period, it is recommended that the lease be renewed for a term of two years.

The following resolution is submitted for adoption:

Resolved, That the Commissioners of the Sinking Fund be, and they are hereby, requested to authorize the Comptroller to execute a renewal of the lease of the premises on the southwest corner of Radde and Payntar avenues, Long Island City, used as an annex to Public School 4, for two years from March 1, 1902, on the same terms and conditions now in force.

The Commissioners of the Sinking Fund of the City of New York:

GENTLEMEN--At a meeting of the Board of Education held on December 11, 1901, a report was presented by the Committee on Buildings, of which I am Chairman, requesting that the lease of the premises on the southwest corner of Radde and Payntar avenues, Long Island City, Borough of Queens, be renewed for a term of two years from March 1, 1902, on the same terms and conditions now in force, the rental being $540 per annum.

At the time this report was presented, the terms as stated therein were the best that could be obtained for a renewal. Since then, however, a communication has been received from Miss Mary Smith, attorney for the heirs of John Smith, owner of the property, stating that she would be willing to renew the lease for a term of two years on the same conditions at an annual rental of $480 instead of $540.

Will you therefore kindly authorize the lease in question on the same terms at an annual rental of $480 instead of $540?

The Committee on Buildings respectfully reports that at the last meeting of this Board a report was presented and adopted requesting the Commissioners of the Sinking Fund to authorize the Comptroller to execute a renewal of the lease of the premises on the southwest corner of Radde and Payntar avenues, Long Island City, used as an annex to Public School 4, Borough of Queens, for two years, at an annual rental of $540, which were the best terms that could be obtained at that time. Since that date, however, the owner has sent a communication to the Deputy Superintendent of School Buildings of that Borough, agreeing to reduce the rental to $480 per year.

Upon receipt of this information, your Committee addressed a letter to the Commissioners of the Sinking Fund, stating the facts in the case and asking that the renewal be authorized at an annual rental of $480 instead of $540, as contained in the report mentioned. It is therefore requested that such action be approved, and the report found on pages 1605-1606 of the Journal of 1901 be amended.

The following resolution is submitted for adoption:

Resolved, That the resolution adopted by the Board of Education on December II, 1901 (see Journal, pages 1605-1606), requesting the Commissioners of the Sinking Fund to authorize the Comptroller to execute a renewal of the lease of the premises on the southwest corner of Radde and Payntar avenues, Long Island City, for two years from March 1, 1902, be, and it is hereby, amended by striking out the amount "$540" and inserting "$480."

In connection therewith the Comptroller presented the following report of the Engineer of the Department of Finance and offered the following resolution:

Hon. BIRD S. COLER, Comptroller:

December 26, 1901.

SIR-The Board of Education at a meeting held December 11, 1901, adopted the following resolution:

"Resolved, That the Commissioners of the Sinking Fund be, and they are here"by, requested to authorize the Comptroller to execute a renewal of the lease of "the premises on the southwest corner of Radde and Payntar avenues, Long Island "City, used as an annex to Public School 4, for two years from March 1, 1902, on "the same terms and conditions now in force."

The lessor is Mary Smith, as attorney in fact for the heirs at law of John H. Smith, deceased.

It appears from the records I have been able to obtain, in regard to this matter, that the Board of Education of Long Island City entered into a lease on the third day of September, 1896, with John Smith for the use of these premises.

The lease was to run for one year from September 1, 1896, at $540 per annum, payable quarterly.

I am informed at the time of consolidation that the premises were still being used for school purposes.

The School Board for the Borough of Queens took control on February 1, 1898, and the rent of these premises was paid from February 1 to September 1, 1898, upon certificates issued by the principal of the school that the same were being used for school purposes, and at the terms provided in the original lease.

At a meeting of the Board of Education held September 28, 1898, resolutions were adopted, requesting the Commissioners of the Sinking Fund to authorize leases of certain buildings in the Borough of Queens, of which this was one. (Minutes, November 10, 1898, page 255).

The Commissioners of the Sinking Fund on January 20, 1899, authorized a lease ior three years, at $540 per annum, which was executed on the 29th day of March, 1899, and took effect as of September 1, 1898, as will be seen from Queens "A" voucher No. 2655 of 1899.

In consequence, I consider that the lease expired on September 1, 1901, and that a renewal should be made from that date, instead of from March 1, 1902, as requested.

Since the resolution first above referred to was passed, Mr. Richard H. Adams, Chairman, Committee on Buildings, Board of Education, has addressed a communication to the Commissioners of the Sinking Fund, wherein he states that the lessor will now accept $480 per annum from March 1, 1902, instead of $540, as provided for in the resolution.

This rental appears to me full, but not excessive, and I would therefore recommend that the Commissioners of the Sinking Fund authorize a renewal of the exist ing lease for two years from September 1, 1901, at a rental of $540 per annum f

Smith, of premises on the southwest corner of Radde and Payntar avenues, Borough of Queens, used as an annex to Public School 4, for a term of two years from September 1, 1901, at a rental at the rate of Five hundred and forty dollars ($540.00) per annum from September 1, 1901, to March I, 1902, and Four hundred and eighty dollars ($480.00) per annum from March 1, 1902, payable quarterly, otherwise upon the same terms and conditions as contained in the existing lease-the Commissioners of the Sinking Fund deeming the said rent fair and reasonable and that it would be for the interests of the City that such lease be made.

The report was accepted and the resolution unanimously adopted.

The Comptroller presented the following resolution adopted by the Board of Education relative to an amendment to resolution authorizing a lease of premises corner of Wilbur avenue and Prospect street, Long Island City, Borough of Queens, together with a report of the Engineer of the Department of Finance thereon, and offered the following resolution:

Resolved, That the resolution attached to the report of the Committee on Buildings, relative to the renewal of the lease of the building on Wilbur avenue and Prospect street, Long Island City, Borough of Queens, presented to the Board of Education on September 23, 1901, and adopted (see Journal, page 891) be, and it hereby is, rescinded; and be it

Resolved, That the Commissioners of the Sinking Fund be, and they are hereby, requested to authorize the Comptroller to execute a renewal of the lease of the premises on Wilbur avenue and Prospect street, Long Island City, Borough of Queens, used as an annex to Public School 4, for one year from September 1, 1901, date of expiration of the present lease, at an annual rental of $800, the other conditions to be the same as those of the former lease.

The resolution of the Board of Education of September 23, 1901, referred to above, was the subject of a report by me under date of October 10, copy of which is enclosed, together with the resolution of the Commissioners of the Sinking Fund adopted October 11, 1901 (page 373).

The lessor has declined to sign a lease with a renewal term at $600.00 per annum, and in consequence the Board of Education has passed the above resolution providing for the current year, from September 1, 1901, instead of September 15, which was in error before.

I believe that before any action is taken on this new resolution the Board of Education should be required to show the Commissioners of the Sinking Fund either that accommodations will be provided these children after September 1, 1902, in a new city school building, or that other quarters can be secured at a reasonable rental, otherwise they will probably hold over on the same lease as they have done in the present instance.

Resolved, That the resolution adopted by this Board at meeting held October 11, 1991, authorizing a renewal of the lease of premises on the southeast corner of Wilbur avenue and Prospect street, Borough of Queens, for the use of the Board of Education, be and the same is hereby amended so as to read as follows:

Resolved, That the Commissioners of the Sinking Fund hereby approve of and consent to the execution by the Board of Education, of a renewal of the lease to the City, from Margaret Loretto Callahan, of premises on the southeast corner of Wilbur avenue and Prospect street, Borough of Queens, used as an annex to Public School 4, for a term of one year from September 1, 1901, at an annual rental of Eight hundred dollars ($800.00), payable quarterly, otherwise upon the same terms and conditions as contained in the existing lease-the Commissioners of the Sinking Fund deeming the said rent fair and 1easonable and that it would be for the interests of the City that such lease be made; and

Resolved, That the Board of Education be and is hereby requested to secure other quarters before September 1, 1902.

The report was accepted and the resolution unanimously adopted.

The following communication was received from Mrs. Mary A. W. Boyd, declining to sign a renewal of the lease of premises corner of Steinway and Potter avenues, Long Island City, occupied by the Board of Education, upon the terms authorized:
