library; to make, as often as they may deem expedient, a full and perfect catalogue of all the books, maps, medals, &c., in the library, which catalogue shall be printed; to prescribe the duties of the secretary and librarian, and of the assistant librarian, and see that they observe them, and, generally, to superintend the interests and management of the library; and to make distribution of the judicial reports, acts, journals, and other documents, as provided by law, in all cases where such distribution shall not be devolved by law upon some other person or officer.

SECT. 4. No salary or compensation shall be allowed to said trustees for their services.

SECT. 5. For the appointment of secretary and librarian, and assistant librarian, and for the adoption of rules and by-laws, and for the election to fill vacancies in the board of trustees, six members shall constitute a quorum. For the transaction of ordinary business, any three members present shall constitute a quorum.

SECT. 6. The annual compensation of the secretary and librarian shall be one hundred and twenty-five dollars, and the assistant librarian shall be paid one dollar and fifty cents per day for his services during such portions of the sessions of the general assembly as the trustees shall deem such services necessary for the public interest.

SECT. 7. The debenture of such assistant librarian shall be allowed and certified by the governor and librarian, and when so allowed and certified, the auditor of accounts shall draw an order upon the state treasurer for the same.

SECT. 8. If any person shall violate any of the rules which have been, or may hereafter be, prescribed by the trustees of the state library, for the regulation thereof, such person shall be liable to pay the state, for the benefit of said library, the several amounts and penalties, by any of such rules required and prescribed.

SECT. 9. All the aforesaid sums and penalties may be sued for and recovered in an action on the case, brought in the name of the state.

SECT. 10. There shall be, and hereby is, appropriated an annual sum of money, not to exceed two hundred dollars, to be expended under the direction of the trustees of the state library, in the purchase of books, maps, documents, and historical works, for the use and improvement of the state library.

SECT. 11. The said trustees shall cause an accurate account of such expenditures to be kept, and such account shall be audited by the auditor of accounts, who shall draw orders on the treasury therefor.

SECT. 12. Said trustees shall, at all times, be subject to the order and control of the general assembly.

AN ACT TO APPROPRIATE MONEY FOR THE STATE LIBRARY. It is hereby enacted by the General Assembly of the State of Ver

mont:

SEC. 1. An additional annual sum of three 'hundred dollars is hereby appropriated, to be expended under the direction of the trustees of the State Library, in the manner now provided by chapter seven of the General Statutes, entitled "Of the State Library."

SEC. 2. This act shall take effect from its passage.

AN ACT RELATING TO THE SALARY OF THE STATE LIBRARIAN, AND PAY OF ASSISTANTS THEREOF.

It is hereby enacted by the General Assembly of the State of Vermont:

SEC. 1. The salary of the State Librarian shall be three hundred and fifty dollars annually, and be paid quarterly. The provisions of this act shall extend to the salary of the present year, commencing October 1, 1870.

SEC. 2. The State Librarian is hereby authorized to employ two assistants during each session of the legislature, whose pay shall not exceed three dollars per day each.

SEC. 3. This act shall take effect from its passage.

JOINT RESOLUTION CONCERNING THE STATE LIBRARY AND OTHER MATTERS [ 1870].

Resolved by the Senate and House of Representatives :

That the Governor is hereby authorized to appoint three Commissioners to devise a plan for the better accommodation for the State Library, the State Cabinet, and the collections of the Vermont Historical Society, and to prepare designs and estimates for the same, and to report to the legislature at its next session.

AN ACT IN RELATION TO THE VERMONT HISTORICAL SOCIETY.

It is hereby enacted by the General Assembly of the State of Ver

mont:

SEC. 1. Whenever the Vermont Historical Society shall be dissolved, the books, collections, and all the property thereof shall become the exclusive property of the State of Vermont; and said society shall have no right or power to sell or dispose of any part of its books or collections, except by way of exchange; and all such sales or disposal shall be void.

SEC. 2. The Secretary of State, the Auditor of Accounts and the State Librarian shall be ex officio members of the Historical Society aforesaid, and of the board of curators thereof.

SEC. 3. The sum of two hundred and fifty dollars is hereby appropriated to aid the said Historical Society in the preservation of its valuable collections, and to put the same in suitable condition for examination and use.

SEC. 4. The aforesaid sum of money shall be paid to the curators of said society on the order of the Governor, and said curators shall settle with the Auditor of Accounts for the proper expenditure of said sum of money.

SEC. 5. This act shall not take effect until the said society shall by a vote thereof at a meeting regularly called and holden accept of and adopt this act.

RULES OF THE LIBRARY.

1.

The Library shall be kept open each day, at suitable hours, of every session of the Legislature and Constitutional Convention, when the Librarian or his Assistants shall be present. And no person shall be allowed access to the Library at any time except in the presence of the Librarian or Assistants.

Books may be taken from the Library by the Governor and Lieutenant Governor; the Secretary of Civil and Military Affairs; members of the Senate and House and their Clerks; members of of the Constitutional Convention and its Clerks; Heads of Departments; Judges of the Supreme Court; Trustees of the Library; Secretary and members of the Board of Education.

The right to take and keep books by the members and clerks of a Legislature, or Constitutional Convention, is limited to the time said Legislature or Convention may be in session, and no other person shall keep a book from the Library more than twenty days.

The Librarian shall keeps records in which he shall enter all books taken from the Library; and every person taking a book shall be responsible for its return agreeably to the rules of the Library, until the Librarian shall cancel the charge. And no book shall be taken from the Library until the same has been so charged.

5.

Every book placed on the shelves of the Library shall be stamped on the outside and inside, when practicable, with the words, "Vermont State Library,” in such a manner as to be indelibly inscribed.

6.

The Librarian, in suitable books, shall keep a record of all the transactions of the Library in the purchase and exchange of books, and also of all the expenses of the Library, for the examination of the Trustees and the Committee on the Library.

7.

The Librarian, in the discharge of his duties, shall in all matters be subject to the control of the Trustees of the Library, and shall keep a full record of all their proceedings.

8.

The Library and Library Rooms shall be under the control and charge of the Librarian, and he shall carefully preserve the books and all other property belonging to the Library; and if any loss or damage to the same shall happen from his want of care, or any violation of the rules of the Library, by him permitted, he shall be personally responsible for the same.

9.

If on notice to any person that the time for which any book or books have been drawn from the Library by such person, has expired, such person shall neglect to return such book or books to the Library for more than three days after such notice, such person shall be liable to pay to the State double the value of such book or books, which value shall be estimated at the cost of replacing the same.

10.

If any person shall take from the Library any book or other article belonging to the same, without being properly authorized so to do, such person shall be liable to pay to the State double the value of such book or other article, and shall also pay a penalty of ten dollars.

11.

If any person shall have in his possession any book or other article belonging to the Library, and shall neglect to return the same to the Library on demand, such person shall be liable to pay to the State double the value of such book or other article, and also a penalty of ten dollars.

12.

If any book shall be damaged while the same shall be drawn from the Library by any person, such person shall be liable to pay to the State the amount of such damage.
