Which were unanimously adopted.

The following communication was received from the Board of Docks, granting permission to the New York Central and Hudson River Railroad Company to widen West street in front of its piers at Barclay street and Park place:

NEW YORK, September 27, 1894.

Hon. THOMAS F. GILROY, Mayor, and Chairman of the Commissioners of the Sinking
Fund:

SIR-At a meeting of the Board of Docks, held on the 27th instant, a communication was received from the New York Central and Hudson River Railroad Company, requesting permission to improve the water-front in front of its piers at Barclay street and Park place, and the adjacent bulkheads, the work to be done in accordance with the new plan. A copy of the communication from said company, dated May 29, 1893, together with that above referred to, dated September 26, 1894, are hereto annexed; and, in accordance with the provisions of section 712, chapter 410, Laws of 1882, as amended by chapter 397, Laws of 1893, the Board of Docks, at its meeting, held September 27, 1894, adopted the following resolution, permitting the private owners of the bulkhead property between Piers, old 25 and 28, North river, to make the necessary improvements thereto, so as to conform with the plans already adopted by this Department and approved by the Commissioners of the Sinking Fund.

Resolved, That, if the Commissioners of the Sinking Fund approve, permission be and hereby is granted the New York Central and Hudson River Railroad Company to extend the bulkhead line of the property extending along the westerly side of West street, from the southerly line of Pier, old 25, to a point one hundred and fifty-five feet north of the northerly line of Pier, old 27, North river, in conformity with the plans adopted by this Department, at the cost and expense of the said company, under the supervision of the Engineer-in-Chief, as provided for in section 715 of the New York City Consolidation Act of 1882, as amended by chapter 397 of the Laws of 1893; provided, however, that the said New York Central and Hudson River Railroad Company shall, within ten days from the receipt hereof, file in this office its written acceptance of the terms and conditions of this resolution.

DEAR SIR-This Company is authorized on behalf of the owners of the piers at the foot of Barclay street and Park place, in this city, and the adjacent bulkheads, or to

be more specific, the property covered by the two leases which this company holds under, to submit the following proposition:

They are willing that the new bulkhead, within the limits above named, shall be constructed by the Dock Department, or by themselves, under the direction or supervision of said Department, at the cost and expense of said private owners, and that portion of the same which is embraced within the piers at the foot of Barclay street and Park place; provided that, to reimburse said private owners for such improvements and the expense of constructing the same on their part, they are to have the same rights in the new bulkhead that thy now have in the present bulkhead, viz.:

The right to collect wharfage, cranage and other emoluments, and in the place and stead of the portions of the bulkhead which are included within the piers above named, that they be at liberty to extend the existing piers to the pier-line, upon the plan adopted by the Dock Department, and to hold the same (including those porare to have the same rights in the new bulkhead that they now have in the present so-called Barclay street and Park place piers.

An agreement upon the above basis, between said owners on the one part and the Dock Department on the other part, approved by the Sinking Fund Commissioners of this city, will be executed on the part of said owners and the work can be commenced without delay.

This company, on its part, will covenant to afford any assistance in its power; to pay the cost of the improvements, if necessary, to facilitate the work if done by the Department of Docks under the above agreement, at such times and in such manner as said Department may direct, and if done by it to proceed under the direction of your Department and prosecute the work to completion with all diligence.

PURCHASES OF DOCK RIGHTS.

The Comptroller presented the following report of Engineer McLean, of the Finance Department, on agreements for the purchase of certain wharfage rights on West street, between Perry and West Eleventh streets:

SIR-The Department of Docks has entered into agreements for the purchase of certain bulkhead and water rights on the westerly side of West street, as follows:

Ist. With George H. Budke. Date of agreement, February 21, 1894. For 89 feet 6 inches, more or less, of bulkhead on the westerly line of West street, beginning at the northerly line of Perry street, for the sum of $500 per running foot on West

street.

2d. With Charles N. Lane. Date of agreement, March 8, 1894. For 23 feet of bulkhead on the westerly side of West street, beginning at a point 73 feet northerly of the northerly line of Perry street and running northerly, for the sum of $450 per running foot on West street.

3d. With Henry Chastain. Date of agreement, February 28, 1894. For 43 feet 3 inches of bulkhead on the westerly side of West street, beginning at a point 158 feet northerly of the northerly line of Perry street, for the sum of $450 per running foot on West street.

The water rights and privileges pertaining to the bulkhead proposed as above to be purchased, were granted by the City to Abijah Hammond, as shown on the diagram herewith submitted, May 1, 1821.

The following is the covenant: "And the said parties of the first part, for them"selves and their successors, do covenant and agree to and with the said party of "the second part, their heirs and assigns, that he, the said party of the second part, "his heirs and assigns, paying the said yearly rents hereinbefore mentioned, and "also observing, performing, fulfilling and keeping all and singular the articles "covenants and agreements herein mentioned and contained, according to the true "intent and meaning of these presents, shall, and lawfully may, from time to time, "and at all times forever hereafter, fully have, enjoy, take and hold to his and their "only proper use all manner of wharfage, cranage, advantages and emoluments "growing or accruing by or from that part of the said wharf or street called West "street, fronting on the North river, which is opposite to the said premises hereby "granted; but it is understood and hereby mutually agreed that the said parties of "the first part, their successors and assigns, shall forever have and enjoy, take and "receive, to their own use and benefit, all the wharfage, cranage, advantages and "emoluments growing or accruing by or from that part of the said wharf or street "which is opposite to the above-mentioned Hammond (West Eleventh street now) "and Perry streets."

The grantees have complied with all the covenants of the grant, and the rights above specified are theirs.

These are the first purchases connected with the recent change of the bulkheadline. They are necessary in carrying out the authorized plan, but I cannot see why there should be a difference in price of $50 per foot in the parcels, which are very near each other. I consider $450 a foot front a full price in this locality.

In connection therewith, the Comptroller presented the following:

Resolved, That the Commissioners of the Sinking Fund hereby approve of an agreement made on the 8th day of March, 1894, between Charles N. Lane and the Mayor, Aldermen and Commonalty of the City of New York, acting by the Department of Docks, for the purchase of all the wharfage rights, terms, easements and privileges appertaining to twenty-three feet of bulkhead on the westerly side of

West street, beginning at a point seventy-three feet northerly of the northerly line' of Perry street, and more particularly described in said agreement, for the sum of four hundred and fifty dollars ($450) per running foot.

Resolved, That the Commissioners of the Sinking Fund hereby approve of an agreement made on the 28th day of February, 1894, between Henry Chastain and the Mayor, Aldermen and Commonalty of the City of New York, acting by the Department of Docks, for the purchase of all the wharfage rights, terms, easements and privileges, etc., appertaining to the forty-three feet and three inches of bulkhead on the westerly side of West street, beginning at a point one hundred and fifty-eight feet northerly of the northerly line of Perry street, and more particularly described in said agreement, for the sum of four hundred and fifty dollars ($450) per running foot front on West street.

Resolved, That the Commissioners of the Sinking Fund hereby approve of an agreement made on the 21st day of February, 1894, between George H. Budke and the Mayor, Aldermen and Commonalty of the City of New York, acting by the Department of Docks, for the purchase of all the wharfage rights, terms, easements and privileges, etc., appertaining to the eighty-nine feet and six inches, more or less, of bulkhead on the westerly side of West street, beginning at the northerly line of Perry street, and more particularly described in said agreement, provided the consideration therein mentioned, five hundred dollars ($500) per running front foot on West street, be reduced to the sum of four hundred and fifty dollars ($450) per running front foot on West street.

Which were unanimously adopted.

An offer of Messrs. Brendlinger & Nearing, Engineers and Contractors, Yonkers, N. Y., for the purchase of 500 cubic yards of stone now in the dump at Shaft 19, New Croton Aqueduct, was received.

Which was referred to the Comptroller with power.

The Comptroller' called up the communication from the District Attorney, received at the last meeting, requesting additional rooms for his use in the New Crim inal Court Building.

Honorable John R. Fellows, District Attorney, was heard in support of the ap

plication.

Discussion followed, in which the questions of the care of the building, the duties of the janitor and the putting of the elevator men in uniform were considered.
