In connection therewith the Comptroller offered the following resolution: Resolved, That the Commissioners of the Sinking Fund hereby approve of and consent to the execution by the Commissioner of Street Cleaning, of a lease to the City from Lizzie Silverberg, of the first floor, cellar and yard of the premises No. 303 East One Hundred and Tenth street, Borough of Manhattan, for a term of two years, from May 1, 1904, at an annual rental of three hundred and sixty dollars ($360), payable quarterly, otherwise upon the same terms and conditions as contained in the existing lease; the Commissioners of the Sinking Fund deeming the said rent fair and reasonable, and that it would be for the interests of the City that such lease be made. Which was unanimously adopted.

The Comptroller presented the following report, and offered the following resolution, relative to a renewal of the lease of premises at No. 319 East Twentyfourth street, Borough of Manhattan, for the use of the Department of Street Cleaning:

MARCH 1, 1904.

SIR-In a communication under date of February 3, 1904, the Hon. John McGaw Woodbury, Commissioner of the Department of Street Cleaning, requests a renewal of the lease of the store on the ground floor of premises No. 319 East Twenty-fourth street, Borough of Manhattan, "for another term of two years from May 1, 1904, at an annual rental of $360, payable quarterly, the lessor to take down the centre partition, which at present divides the store, and to make any further necessary repairs required by the Department, otherwise upon the same terms and conditions as in the existing lease.”

The last renewal of this lease was authorized by the Commissioners of the Sinking Fund May 7, 1902 (see minutes Sinking Fund, page 427), at an annual rental of $300.

In an interview with Mr. Klappert, he agrees to renew the lease at $27.50 a month, of $330 per annum, and as this is a reasonable rent, I would respectfully recommend that the Commissioners of the Sinking Fund authorize a renewal of the lease of the store on ground floor of premises No. 319, East Twenty-fourth street, Borough of Manhattan, for another term of two years from May 1, 1904, at an annual rental of $330, payable quarterly, the lessor to take down the centre partition, which at present divides the store, and to make any further necessary

repairs required by the Department; otherwise upon the same terms and conditions as are in the present existing lease. Emil W. Klappert, lessor. Respectfully submitted for approval.

The report was accepted and the resolution unanimously adopted.

The Comptroller presented the following report and offered the following resolution, relative to a lease of premises at No. 261 West One Hundred and Twenty-third street, Borough of Manhattan, for the Department of Street Cleaning:

MARCH 11, 1904.

SIR-In a communication under date of February 5, 1904, the Hon. John McGaw Woodbury, Commissioner of the Department of Street Cleaning, requests the renewal of lease of premises No. 261 West One Hundred and Twenty-third street, Borough of Manhattan, for a term of five years from May 1, 1904, at an annual rental of $600.

Upon examination of this property it was found that the Department of Street Cleaning only occupied the lower or ground floor of the premises, and it would not be for the best interests of the City to lease a whole building when only the store or ground floor was necessary. I communicated with the lessor, J. Archibald Murray, and he agreed to lease the portion desired by the Department of Street Cleaning, as mentioned in his letter dated March 3, 1904.

In a subsequent communication under date of March 10, 1904, Captain Gibson, Deputy and Acting Commissioner of the Department of Street Cleaning, requests a renewal of lease of the portion of premises now occupied by his Departmentthat is to say, the ground floor of No. 261 West One Hundred and Twenty-third street, in the Borough of Manhattan-for a term of three years from May 1, 1904,

at an annual rental of $450, payable quarterly, otherwise upon the same terms and conditions as contained in the existing lease.

This being satisfactory, I respectfully recommend such a renewal, for a term of three years from May 1, 1904, at an annual rental of $450, payable quarterly, otherwise upon the same terms and conditions as contained in the existing lease, City to pay for Croton water used by the Street Cleaning Department. Lessor, J. Archibald Murray.

The report was accepted and the resolution unanimously adopted.

The Comptroller presented the following report and offered the following resolution relative to a lease of premises at No. 1368 Avenue A, Borough of Manhattan (southwest corner of Seventy-third street), for the Department of Street Cleaning: FEBRUARY 27, 1904.

SIR-The Hon. John McGaw Woodbury, Commissioner of the Department of Street Cleaning, in a communication under date of February 16, 1904, requests the Commissioners of the Sinking Fund for a lease "from James A. Mahony (Fred B. Wilson, real estate agent, No. 978 Lexington avenue, Borough of Manhattan) of the store and four (4) rooms in the basement of premises known as No. 1368 Avenue A, Borough of Manhattan (southwest corner of Seventy-third street), for a term of three (3) years from May 1, 1904, at an annual rental of $600, payable quarterly, the lessor to put and keep the premises in good tenantable repair, the City to pay for the Croton water used on the premises.

"The store is about 26 by 52 feet, and the four (4) rooms in the basement are each about ten (10) feet square.

"This is to take the place of the premises at No. 370 East Seventy-sixth street, now leased by this Department, the lease of which will expire May 1, next."

I have had this property examined by Mr. O'Sullivan, of this Bureau, and he reports that the premises No. 1368 Avenue A is the southeast corner of Avenue A and Seventy-third street, not the southwest corner, as mentioned in the letter of Commissioner Woodbury.

The store is 23 feet 7 inches wide by 39 feet deep, and three small rooms in the basement, each about 10 feet square.

I would consider the rent asked of $600 per annum a full rent, but not excessive, and as it is better adapted and affords more space than the present premises now leased by the Street Cleaning Department at No. 370 East Seventy-sixth street, I would respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of the store and three rooms in the basement of premises known as No. 1368 Avenue A (southeast corner Seventy-third street), Borough of Manhattan, for a term of three years from May 1, 1904, at an annual rental of $600, payable quarterly; lessor to put and keep the premises in good tenantable repair and pay for the Croton water used on the premises. Lessor, James A. Mahony (Fred B. Wilson, real estate agent, No. 978 Lexington avenue, Borough of Manhattan).

The Comptroller presented the following report and offered the following resolution, relative to a lease of Room No. 404, in the building No. 258 Broadway, Borough of Manhattan, for the Commissioners of Estimate and Appraisal in Condemnation Proceedings:

MARCH 9, 1904.

SIR-In a communication under date of March 4, 1904, the Commissioners of Estimate and Appraisal in Condemnation Proceedings request a lease of Room 404 in the building No. 258 Broadway, Borough of Manhattan, for a term of two years, from May 1, 1904, at an annual rental of $425, and the cancellation of lease of Room 414.

The reason for such new lease and cancellation of old lease is stated to be that Room 414 is an inside room, quite dark, not connected in any way with their present rooms, while Room 404 fronts on Warren street, and is in connection with the present set of offices.

The lease of Room 414 was authorized by the Commissioners of the Sinking Fund April 1, 1903.

I have had this room examined and find its area to be 211.9 square feet, being 13 by 16.3 feet. It is now rented to some other tenant, but it is understood it will be vacant by May 1, and as the rent asked is reasonable, I see no objection to the cancellation of the lease of Room 414 and making a new lease for Room 404, therefore I respectfully recommend that the Commissioners of the Sinking Fund authorize a lease of Room 404 in the building No. 258 Broadway, Borough of Manhattan, for a term of two years, from May 1, 1904, at an annual rental of $425, payable monthly, lessor to furnish light, heat and janitor service. Lessors, Rogers, Peet & Company, and also recommend the adoption of a resolution canceling the lease of Room 414, in accordance with a letter from Rogers, Peet & Company, under date of March 3, 1904, said cancellation to take effect May 1, 1904.

Whereas, The Commissioners of Estimate and Appraisal, in a communication dated March 4, 1904, have requested the Commissioners of the Sinking Fund to authorize the lease of Room No. 404 in the building at No. 258 Broadway, Borough of Manhattan, and the cancellation of the lease of Room No. 414 in said building, which lease expires on May 1, 1906; and

Whereas, Messrs. Rogers, Peet & Company, the owners of said building, in a communication dated March 3, 1904, have agreed, in the event of the Commissioners of the Sinking Fund adopting a resolution authorizing the lease of Room No. 404 for a term of two years, from May 1, 1904, at an annual rental of four hundred and twenty-five dollars ($425), to surrender and cancel the lease of Room No. 414; therefore be it

Resolved, That the Corporation Counsel be and is hereby requested to prepare a lease to the City, from Messrs. Rogers, Peet & Company, of Room No. 404, in the building at No. 258 Broadway, Borough of Manhattan, for the use of the Commissioners of Estimate and Appraisal in Condemnation Proceedings, for a term of two years, from May 1, 1904, at an annual rental of four hundred and twenty-five dollars ($425), payable monthly, the lessors to furnish light, heat and janitor service, it being understood and agreed that the lease of Room No. 414 shall be canceled upon the execution and delivery of this lease; and the Commissioners of the Sinking Fund, deeming the said rent fair and reasonable, and that it would be for the interests of the City that such lease be made, the Comptroller be and is hereby
