Resolved, That the resolution adopted by this Board at meeting held February 5, 1904, authorizing a renewal of the lease of premises No. 128 Livingston street, Borough of Brooklyn, for the Department of Public Charities, be and the same is hereby rescinded.

Resolved, That the Corporation Counsel be and is hereby requested to prepare a lease to the City, from Elias H. Seaman, of premises No. 128 Livingston street, Borough of Brooklyn, for the use of the Department of Public Charities, for a term of five years from April 1, 1904, at an annual rental of one thousand dollars ($1,000), payable quarterly; the City, in addition, to pay water rates and the lease to contain the following clauses:

"The City to have the privilege of terminating this lease at any time during its term, on three months' notice, if the Department is furnished quarters in the proposed new municipal building; also the clause, that if Livingston street is widened during the term of the lease, this lease to terminate immediately on the vesting of title in the City and without recourse to either party'; and the Commissioners of the Sinking Fund, deeming the said rent fair and reasonable, and that it would be for the interests of the City that such lease be made, the Comptroller be and is hereby authorized and directed to execute the same when prepared and approved by the Corporation Counsel, as provided by sections 149 and 217 of the Greater New York Charter."

Resolved, That the resolution adopted by this Board at meeting held February 5, 1904, authorizing a renewal of the lease to the City of premises No. 126 Livingston street, Borough of Brooklyn, for the use of the Department of Public Charities, be and the same is hereby rescinded.

Chauncey Real Estate Company, as agents, of premises No. 126 Livingston street, Borough of Brooklyn, with alley and horseshed adjoining, for the use of the Department of Public Charities, for a term of five years, from April 1, 1904, at an annual rental of one thousand dollars ($1,000), payable quarterly; the City, in addition, to pay the water rates, and the lease to contain the following clauses:

The Comptroller presented the following report and offered the following resolution, relative to a renewal of the lease of premises No. 1237 Franklin avenue, Borough of The Bronx, for the use of the Health Department:

APRIL 7, 1904.

SIR-The Department of Health, in a communication under date of April 4, requests a renewal of a lease of the premises No. 1237 Franklin avenue, Borough of The Bronx, now occupied by the Department of Health for office purposes, upon the following terms:

The rent to be at the rate of $1,200 per annum, and the lease to extend from May I, 1904, to April 30, 1905.

The Commissioners of the Sinking Fund, at a meeting held on March 16, 1899, adopted a resolution authorizing the present existing lease, at an annual rental of $1,200 per annum, for a period of five years, the owner to make certain repairs upon the house. While this is in part a renewal, the term of the lease is for one year instead of five.

I would respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of the premises No. 1237 Franklin avenue, in the Borough of The Bronx, for the use of the Department of Health for office purposes, at an annual rental of $1,200, payable quarterly, for a period of one year, from May 1, 1904, otherwise upon the same terms and conditions as contained in the present existing lease. The report was accepted and the resolution unanimously adopted.

The Comptroller presented the following report and offered the following resolution, relative to a lease of premises No. 757 Myrtle avenue, Borough of Brooklyn, for the use of the President of the Borough:

APRIL 7, 1904.

SIR-In a communication under date of March 30, 1904, the Superintendent of the Bureau of Public Buildings and Offices of the Borough of Brooklyn, requests a lease of premises No. 757 Myrtle avenue, Borough of Brooklyn, for a term of one year at an annual rental of $360 for a storehouse for the use of the President of the Borough. This is to take the place of the present storehouse at No. 195 Atlantic

avenue.

I have had the premises examined and have the honor to report that this is a 2-story frame building on Myrtle avenue near Nostrand avenue, the portion to be leased being the store or ground floor, 24 feet by 83 feet in size.

I consider the rent asked, $360 per annum, reasonable and would therefore respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of the store or ground floor of the premises No. 757 Myrtle avenue, Borough of Brooklyn, for a term of one year from date of occupation at an annual rental of $360, lessor to make any necessary repairs. Lessor, Michael Regan, No. 759 Myrtle avenue, Brooklyn.

The Comptroller presented the following report and offered the following resolution relative to a lease of premises No. 761 East One Hundred and Sixty-third street, Borough of The Bronx, for the use of the Police Department:

MARCH 31, 1904.

SIR-The Police Commissioner, in a communication under date of March 29, requests the approval of the Commissioners of the Sinking Fund to a lease of prem

ises No. 751 East One Hundred and Sixty-third street, in the Borough of The Bronx, to provide a temporary stable for the Thirty-sixth Precinct for a period of one year, "with semi-annual renewal as long as may be required," rental $1,200 per annum, payable monthly, the Police Department to make alterations and repairs and light, heat and water to be furnished or paid for by the City, janitor services to be attended to by the Hostlers of the Department. The necessity of the lease is owing to the tearing down of the present station and stable of the Thirty-sixth Precinct, for the purpose of erecting new buildings, and that sufficient appropriation has been made to cover the rent.

Last October a request was made by the Police Department for a lease of the same premises. The rental asked was $150 per month or $1,800 per annum. In our report, made at that time, we considered this rent excessive, and believed $100 was full rental value for the accommodation to be furnished the City.

The property desired to be leased is known as lot 58, Block 2368, section 9, on land map of the County of New York, "an irregular parcel 25 feet front by 68.64 "feet, and connecting with an interior plot 100 feet by 100 feet. Upon this interior "plot there are several two-story frame buildings, used as stables, storage rooms "and as a soda water manufactory. Mr. Garland informs me that the part of the "property to be occupied by the Police Department includes only an upstairs stable room 28 feet by 60 feet, with 22 stalls, a hay room adjoining 15 feet by 35 feet, a 'runway and harness room about 30 feet by 10 feet, and in addition the Department to have the privilege of storing four vehicles under a covered shed on the ground 'floor. The stable is practically new and in good condition, and has a concrete floor "between the rows of stalls."

The rent being reasonable and just, I would respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of this property from date of occupation for a period of one year, with semi-annual renewal as long as may be required at an annual rental of $1,200, payable monthly, the City to assume the obligation of water, light, heat and janitor service, and the lessor, Samuel Garland, No. 751 East One Hundred and Sixty-third street, to remove all the manure from the premises.

The Comptroller presented the following statement and offered the following resolution relative to bill of the Mail and Express Company for printing minutes of the meeting of the Commissioners of the Sinking Fund:

To the Commissioners of the Sinking Fund:

APRIL 5, 1904.

GENTLEMEN-I present herewith a bill of the Mail and Express Company, amounting to eight hundred and eighty-one dollars and seventy-five cents ($881.75), for printing 100 copies of the minutes of the meetings of the Commissioners of the Sinking Fund, from October 16 to December 31, 1903, and index to same, and for binding eighty-five (85) volumes of said minutes.

The bill has been examined and found to be correct, and prices charged are reasonable and just. I offer the following resolution to pay the said bill from the appropriation of expenses of the Commissioners of the Sinking Fund.

The Comptroller presented the following statement and offered the following resolutions, relative to the change of title of Miss Bertha M. Schmitt, from Stenographer and Typewriter to Clerk:

APRIL 6, 1904.

GENTLEMEN-At a meeting of this Board held February 4, 1903, a resolution was adopted approving of the appointment by the Secretary of a Stenographer and Typewriter, said appointee to be taken from the Civil Service list. On January 22, 1903, Miss Bertha M. Schmitt was appointed to such position. Since this appointment was made, however, Miss Schmitt has gradually become more valuable to the Secretary as a Clerk than as a Stenographer and Typewriter, and it is therefore desired that
