The records of this department show an award made to St. Patrick's Church, a corporation, for parcel damage No. 11-F, in the proceeding to open Payntar Ave., amounting to the sum of $3,000, which was paid on June 27, 1907.

"An award was also made to St. Patrick's Church of Long Island City for parcel damage No. 5-J-J, in the proceeding to open Academy Street, which amounts to the sum of $1.51, and still remains unpaid."

The foregoing awards were taken into consideration by the Commissioners of the Sinking Fund in determining the terms upon which relief should be granted on a former application under section 221A of the Charter, made by the above named corporation and acted upon by the Commissioners on September 16, 1914 (Minutes for 1914, pages 825 to 827). It appeared that one of the assessments sought to be cancelled and included in such former application was levied in the same proceeding in which the foregoing award of $3,000 was made. In view of such fact, it was required that, as a condition to the cancellation of all of the open charges, including the assessment in question, the petitioner be required to pay the principal of such assessment, i. e., $2,245.40, together with interest at the rate of four (4) per cent per annum, from the date when the same became a lien, viz., August 26, 1909, and, in addition, the sum of $1.51, representing the unpaid award above set forth, and a resolution was accordingly adopted by the Commissioners on said September 16, 1914, embodying such requirements. Said resolution was thereafter carried into effect. and the sum required by the terms thereof to be paid as a condition to cancellation was paid by said corporation.

The records of this department show further that in the proceeding for the "Opening of Radde St., from Payntar Ave. to Ridge St., in the 1st Ward, Queens." an award for damage parcels Nos. 15A and 16A, in the sum of $350, was made to St. Patrick's Church, and that awards for damage parcels Nos. 15 and 16, in the sums of $1.17 and $2.34, respectively, were made to an unknown owner, and that said three awards, aggregating $353.51. still remain unpaid.

Such records show further that the property affected by damage parcels Nos. 15 and 15A was lot 1, block 92, and that affected by damage parcels Nos. 16 and 16A was lot 13, block 92, both lots being included in the petition herein.

Said records show further that in the proceeding for the "Opening of Crescent, from Hunter Ave. to Winthrop Ave., First Ward. Queens." an award for damage parcels Nos. 6HH and 6II, affecting lots 13 and 16, block 100 (included in the petition herein), amounting to $988, was made to an unknown owner and that said award still remains unpaid.

In view of said unpaid awards, and the fact that the same affect the property which is the subject of this application, I recommend that as a condition to cancellation of the open charges hereinbefore set forth, the petitioner be required to pay a sum equivalent to the aggregate amount of said unpaid awards, i. e.. $1,341.51, and. in addition, the sum of $100 to cover any interest that might possibly be added to

said awards, or any of them, at the time of the payment of the same by the City to the petitioner or its assigns, making the total amount to be paid by the petitioner, as a condition to the cancellation of said assessments, $1,441.51.

The petitioner has included in its application the first to the twelfth instalments of the "General Improvement Commission" assessment, levied under chapter 644, laws 1893, affecting lot 13, block 100. The first instalment of said assessment was levied and became a lien in the year 1903, and the whole assessment accrued, therefore, in that year.

In view of the fact that said property was not exempt from taxation in the year 1903, as appears from the records of the Department of Taxes and Assessments, I refuse to certify my approval of the cancellation of said instalments, on the ground that it does not appear that the property (lot 13, block 100) was entitled to exemption from local taxation during the times that said assessment accrued and became a lien thereon, as required by said section of the charter.

The records of this department show no lease to the City of New York of any of the property hereinbefore described.

The total amount involved as principal in the above assessments is $4,465.20. The property affected by these assessments is located in the Borough of Queens, Lot 1, Block 92, Radde St., Academy St. and Payntar Ave., Lot 13, Block 100, Crescent St. to Prospect St., between Wilbur and Beebe Avenues.

The Rector, Rev. Joseph P. McGinley, in response to a request, has submitted a financial statement for the last fiscal year, showing the total receipts from all sources to be $14,510.25, and the expenditures for all objects, $14,499.25, leaving a balance of $11.00.

It appearing, therefore, that the petitioner was the actual owner of the real estate in question and entitled to have the same exempted from taxation during the time when said assessments above mentioned accrued and became liens thereupon, I am of the opinion that the petitioner has presented a proper case for relief to the Commissioners of the Sinking Fund of The City of New York, under the provisions of section 221A of the Greater New York Charter, except as to the instalments of the assessment which I have refused to certify for cancellation, and I therefore certify my approval of the application of St. Patrick's Church, in Long Island City, Newtown, Queens County, Long Island, New York, to the extent I have hereinbefore indicated as proper, pursuant to the provisions of such section of the Charter, and recommend that the liens above set forth as the ones which may properly be cancelled, be cancelled upon the payment of $1.441.51, provided that payment be made within sixty days from the date of the resolution authorizing such payment and provided that at the time of such payment, said corporation furnish proof by affidavit that it is the actual owner of the property affected, and that the same is not under contract of sale.

That, upon payment of the sum of fourteen hundred and forty-one dollars and fifty-one cents ($1,441.51) within sixty days from date, the Commissioners of the Sinking Fund by unanimous vote, hereby authorize and direct the Comptroller, pursuant to the provisions of Section 221-A of the Charter to cancel the following assessments levied and assessed against property owned by St. Patricks Church, in Long Island City, Queens County, Long Island, N. Y., provided that at the time of such payment said corporation furnish proof by affidavit that it is the actual owner of the property affected, and that the same is not under contract of sale.

COMMISSIONERS OF THE SINKING FUND OF THE CITY OF NEW YORK.

Proceedings of the Commissioners of the Sinking Fund, at a Meeting Held in Room 16, City Hall, at 3 o'Clock P. M., on Thursday, November 18, 1915.

Note The meeting was originally called for Wednesday, November 17, 1915, and postponed because of a quarum not being present.

The minutes of the meeting held November 3, 1915, were approved as printed. Dock Department-Lease to Joseph Gordon, Inc., of Certain Property in the Vicinity of 38th Street, East River, Borough of Manhattan. The following was received from the Commissioner of Docks:

Sir-On February 11, 1914, the Commissioners of the Sinking Fund adopted resolution approving of and consenting to the execution by the Commissioner of Docks of a lease to Joseph Gordon, Inc., of certain property in the vicinity of 38th street, East River, which is more particularly described in the minutes of that date, which lease, however, was not executed, delivered or recorded until in June, 1914.

In April, 1914, Mary E. Jones obtained from the City of New York a deed to certain property located on the south side of East 38th street, easterly of First avenue, which included part of the property described in the lease to Joseph Gordon, Inc., comprising an area of about 630 square feet, as shown hatched in black on accompanying map.

The area hatched in red on the accompanying map, lying along the westerly line of the property leased to Joseph Gordon, Inc., containing 779 square feet, is owned by the City and is unleased, although occupied more or less by private parties without authority. It can only be reached through private property or over the land leased to Gordon and is therefore of little value as compared with the 630 square feet located on the street. I believe it would be to the City's interest to include this parcel in the lease to Joseph Gordon, Inc., in lieu of the 630 square feet which will have to be deducted, owing to the deed to Mrs. Jones. Gordon has agreed to accept the substitution.

I therefore beg to recommend that the lease dated March 14, 1914, by and bettween the City of New York, by the Commissioner of Docks, party of the first part, and Joseph Gordon, Inc., party of the second part, be amended by changing the description therein so as to read as follows:

All and singular the warfage which may arise, accrue or become due for the use and occupation in the manner and at the rates prescribed by law of

All that certain wharf property situated on the East River, in the Borough of Manhattan, City of New York, County of New York, and known and described as follows, to wit:

Beginning at a point in the bulkhead line established by the Secretary of War in 1900, where the southerly line of East 38th street intersects the same; running thence southwesterly along the bulkhead line a distance 117.6 feet, more or less, to a line parallel with and distant 102 feet 4 inches southerly from the southerly line of East 38th street, measured at right angles therefrom; running thence westerly and parallel to the southerly line of East 38th street, and distant 102 feet 4 inches there from to a point in an old stone retaining wall, said point being distant 207 feet 321⁄2 inches easterly from the easterly line of First avenue; thence northeasterly and along the old stone retaining wall a distance of 61 feet 7 inches to an angle point in said old stone retaining wall, said point being distant 230 feet 6 inches easterly from the east

erly line of First avenue, measured along a line parallel with and distant 45 feet 31⁄2 inches southerly of the southerly line of East 38th street; thence deflecting to the left and running northwesterly and still along the old stone retaining wall a distance of 2 feet 8 inches to an angle point in said old stone retaining wall, said point being distant 227 feet 10 inches easterly from the easterly line of First avenue, measured along a line drawn parallel with and distant 44 feet 8 inches southerly from the southerly line of East 38th street; thence deflecting to the right and running northeasterly and still along the old stone retaining wall a distance of 20 feet 7 inches to a point in said old stone retaining wall distant 233 feet 11 inches easterly from the easterly line of First avenue, measured along a line drawn parallel with and distant 25 feet southerly of the southerly line of East 38th street; thence northerly and along a line drawn parallel with and distant 233 feet 11 inches easterly of the easterly line of First avenue, a distance of 25 feet to its intersection with the southerly line of East 38th street, and thence easterly and along the southerly line of East 38th street a distance of 210 feet and three-fourths of an inch to its intersection with the bulkhead line established by the Secretary of War in 1900 at the point or place of beginning, comprising an area of 19,220 square feet. In connection therewith the Deputy and Acting Comptroller presented the following report and offered the following resolution:

November 10th, 1915.

To the Honorable the Commissioners of the Sinking Fund: Sir-On August 26th, 1915, the Commissioner of Docks recommends that the lease to Joseph Gordon, Inc., of certain wharf property in the vicinity of East 38th street be amended by changing the description thereon.

The wharf property leased to Joseph Gordon, Inc., includes a small plot (530 square feet) located on the southerly side of East 38th street, released to Mary E. Jones, pursuant to a resolution adopted by the Commissioners of the Sinking Fund December 30th, 1913. It appears that there is an interior plot of ground lying along the westerly line of the property leased to Joseph Gordon, Inc., containing 779 square feet, owned by the City and unleased, although occupied more or less by private parties without authority, which plot can only be reached by private property over the land leased to Joseph Gordon, Inc.

The Commissioner in his communication advises that this parcel be included in the lease to Joseph Gordon, Inc., in lieu of the 630 square feet which will have to be deducted owing to the deed to Mrs. Jones. The Commissioner also states that Joseph Gordon, Inc., has agreed to accept the substitution.

I am advised that the value of the interior lot is not more and possibly less than the value of the plot (630 square feet) situated on the southerly side of East 38th street, released to Mary E. Jones.

In view of the complication and the values of the parcels in question which are to be exchanged I advise the adoption of the attached resolution approving the request. Respect fully, ALEX. BROUGH, Deputy and Acting Comptroller.

Whereas, It appears that the wharf property in the vicinity of East 38th Street, East River, Borough of Manhattan, leased to Joseph Gordon, Inc., executed March 13th, 1914, pursuant to a Resolution adopted by the Commissioners of the Sinking Fund on February 11th, 1914, includes a plot containing Six Hundred and Thirty (630) square feet on the south side of East 38th Street, deeded to Mary E. Jones, pursuant to a Resolution adopted by the Commissioners of the Sinking Fund, December 30th, 1913, and

Whereas, The Commissioner of Docks has recommended that in lieu of the plot released to Mary E. Jones that an interior plot lying along the westerly line of the property leased to Joseph Gordon, Inc., containing Seven Hundred and Seventy-nine (779) square feet be included in the lease to Joseph Gordon, Inc., and

Whereas, This substitution has been agreed to by Joseph Gordon, Inc., and Whereas, The Commissioners of the Sinking Fund deeming the interior plot (Seven Hundred and Seventy-nine-779-square feet) to be of equal or less value than the plot (Six Hundred and Thirty-630-square feet) located on the southerly side of East 38th Street, therefore be it

Resolved. That the Commissioners of the Sinking Fund hereby approve of and consent to the execution by the Commissioner of Docks of a lease to Joseph Gordon.
