THE ORIGINAL English Translation of the Frankfort Land pany's Contract, in the handwriting of, and signed by Francis Daniel Pastorious, endorsed on the Back by Pastorious. "A Translation of the Frankfort Companies Contract of Society," folio, 3 PP.

This is Pastorious' own copy and is by far the most important Document in relation to the settlement of Germantown, that we know of the association, and importance of the paper making it of the greatest historical interest.

DECLARATION OF CONSCIENCE, 1687.

HIS MAJESTIE'S Gracious Declaration To all his Loving Subjects for Liberty of Conscience. Given at Whitehall, the fourth day of April, 1687. 4 pp., folio.

A contemporary copy of this interesting document, of which Penn fought so hard to obtain, and of which he speaks in some of his letters described in the early part of this Catalogue. No doubt this is Thos. Lloyd's own copy.

CONTEMPORARY Copy of the Decision of the King and the Lords of the Committee for Trade and Foreign Plantations, in reference to the claim of Lord Baltimore to Delaware, Nov. 13, 1685. Signed at the bottom in the autograph of Wm. Markham, "This is a True coppy of the orignal sent by ye Gover. Wm. Markham, Sec'y." 2 PP., folio.

"The following Report from the Rht. Honble the Lords of the committee for Trade & Forreigne Plantacons, being this Day read at ye board, The Lords of the comitte for Trade and Plantations, haveing pursuant to his late Majtys Order in council of the 31st of May 1683. Examined the matter in Differrence betweene the Lord Baltamore and William Penn Esq. in behalf of his present Majty concerning a Tract of Land in America comonly called Delaware, Their Lordshipps finde that the land intended to be granted by the lord Baltamores Patent was onely Land Uncultivated, and inhabited by Salvages, and that the Tract of Land now in dispute was Inhabited and planted by Christians at and before the Date of the Lord Baltamores Patent as it hath been Ever since to this time, & continued as a Distinct colony from that of MaryLand, Soe that their Lordspps humbly offer their oppinion, That for a voydeing further Differrences, the Tract of Land lyeing between the River and Bay of Delaware and the Easterne Sea, on the one Side, and Chesapeake Bay on the other, be Divided into Equall parts, by a Line from the Latitude of Cape Henlopen to the Fortieth Degree of Northerne Latitude, and that one halfe thereof lyeing toward the Bay of Delaware and the Easterne Sea, be adjudged to belong to his Majty, and that the other halfe remain to the Lord Baltamore, as comprised wthin his charter. Whereas as The Provinciall Councill according to The Powers of ye Psent Commission of Govermt have at their first Sitting chosen a President and have since in a Legislative Councill continued him till they should see cause to alter their choyse, and haveing likewise ordered the Succeeding councills to be called by him, or in his Absence by Notice sent by Six members from this place yett notwithstanding these members, Wm Clark, Luke Watson, Gri. Jones, John Brinkloe, John Cann, Johas D'Haes, Did privily meet together in ye councill Roome, upon ye twenty first Inst. without signifieing ye Leest Syllable of their Intentions of haveing a councill Either to Thomas Lloyd the Elected & continued President or to any Member of ye Province and there in an Irregular & undue Manner have presumed to act as a councill and have Issued forth pretended commissions for constituting Provinciall Judges contrary to ye Express Letter of ye Law and have nominated some therein who under their present Circumstances are unquallifyed for that Station, as upon Occasion shall be made to appeare and have voted Extravagant and contradictory orders.
